MIN FORSKNING

Digitaliseringens betydning for de institutionelle rammer – herunder reguleringsdesign og instrumenter – inden for klima-, miljø- og energiområdet – er mit overordnede forskningsprojekt. Forskningen udføres i samarbejde med kolleger på Juridisk Institut, hvor vi har etableret forskergruppen CREDI (Center for Ret og Digitalisering). Konsekvenserne af digitaliseringen for adgangen til at få efterprøvet de afgørelser, der træffes af myndighederne, har min særlige interesse.

PUBLICERINGER

Den tredje udgave af “Environmental Law Denmark” (2019) er under udgivelse af Walters Kluwer og DJØF Forlag. Alle lovbestemmelser og den relevante praksis på internationalt, EU- og nationalt plan er blevet opdateret frem til 1. juli 2019.

Bogen beskriver, hvordan den danske miljø-, energi- og klimalovgivning skal forstås i lyset af danske traditioner, men at det især er EU’s miljølovgivning, EU Domstolens praksis og international miljølovgivning, der er bestemmende for fastlæggelsen af kravene til miljøets kvalitet, energieffektivisering, vedvarende energi og klima. Den klare sammenhæng mellem EU's lovgivning og internationale konventioner m.v. fremhæves i bogen, hvor det forklares, at den danske lovgivning skal ses som en del af et vertikal harmoniseret system.

De forskellige politiske aftaler, der er indgået mellem de danske politiske partier inden for området  inddrages, hvor  særlige danske løsninger præger lovgivningen. Det gælder ikke mindst ved forklaring af den lovgivning, der er vedtaget ift. landbrugets produktionsforhold.

Den tiltagende digitalisering indgår i bogen som en central del af beskrivelsen af den nyeste udvikling i dansk lovgivning og administration.

MY RESEARCH

The impact of digitalisation on the institutional framework – including regulatory design and instruments – within climate, environment and energy – is my main research project. Research is carried out in collaboration with colleagues at the Department of Law, where we have established the research group CREDI (Center for Legal Informatics). The consequences of ditilalisation on access to justice have my special interest.

PUBLICATIONS

The third edition of “Environmental Law Denmark” (2019) is under publication by Walters Kluwer and DJØEF Publication. The legal provisions at international, EU and national levels have been updated according to current law and practice at International, EU, and national levels as the law in force in Denmark took effect on 1 July 2019.

The EU environmental legislation is very important in the description of Danish environmental law. Therefore, the focal point is on EU environmental law, including case law of the European Court of Justice. The clear relation between EU law and international conventions etc. is described in the book to make it clear that the Danish environmental law is part of a vertical harmonised legal system.

The political agreements on environmental and energy issues between the Danish political parties is part of the explanation of special aspects in the Danish legislation – especially as important frames for the regulation of the pollution from the agricultural activities.

It is described in the book that it is mandatory for all Danish ministries to ensure that all options for adjusting the environmental regulation so that the law is digitalisation-ready and the enterprises and citizens have to use self-services in their communication with the public authorities.
